今朝のNHKニュースで奨学金の返還ができないケースが増えてきているという特集
けさのクローズアップ2013年 4月3日(水) 奨学金が返せない
があって,その中で,「奨学金の回収を強化する動きがあるけれど,とんでもない」という趣旨のコメント(あんまりはっきり聞いてなかったんだけど,そう聞こえた)があったんだけど,倒産法の常識からすると,???なコメントなような。
よく知られているように,USの連邦倒産法では,破産をしても,教育ローンや奨学金については,原則として免責を得ることができない。11 USC Sec. 523には,次のように規定されている:
Sec. 523. Exceptions to discharge(a) A discharge under section 727, 1141, 1228(a), 1228(b), or 1328(b) of this title does not discharge an individual debtor from any debt -
(中略)
(8) unless excepting such debt from discharge under this paragraph would impose an undue hardship on the debtor and the debtor's dependents, for -
(A)(i) an educational benefit overpayment or loan made, insured, or guaranteed by a governmental unit, or made under any program funded in whole or in part by a governmental unit or nonprofit institution; or
(ii) an obligation to repay funds received as an educational benefit, scholarship, or stipend; or
(B) any other educational loan that is a qualified education loan, as defined in section 221(d)(1) of the Internal Revenue Code of 1986, incurred by a debtor who is an individual;

なんでこうなっているのかというのは,比較的簡単な話で。
普通のローンに比べると,教育ローンは,教育が終わった後どうなるかが貸出の時点では見えていないので,リスクが非常に高いし,破産による免責を認めてしまうと,教育が終わった段階ですぐに破産申立をして借金を全部チャラにしてから,収入を得始める,という機会主義的行動を可能にしてしまう。このため,もし,免責OKというスキームにしてしまうと,誰もお金を貸してくれなくなってしまい,その結果,かえって教育を受ける機会を多くの人から奪ってしまう。
だから,教育を受けるチャンスをできるだけ多くの人に確保するためにこそ,教育ローンの取り立てはきちっと行わなければいけないわけだ。
だとすると,先のコメントは,ちょっと的外れだなぁ,と思うわけです。
